Withdrawal from the Contract

If you are a consumer - as a rule, you have the right to withdraw from a distance contract.

You can withdraw from the contract by submitting a declaration of withdrawal from the contract to us, e.g., via email sent to the address: elty@elty.pl

You can withdraw from the contract within 14 days.

The running of the fourteen-day period for withdrawal from the contract begins:

• for a contract in which we deliver an item, being obliged to transfer its ownership - from the day you take possession of the item or a third party indicated by you, other than the carrier, takes possession of the item,
• for digital content - from the day the contract is concluded.

To meet the deadline, it is sufficient to send the declaration before its expiry.

Return the item to us immediately to the address: ul. Przedszkolna 24, 43-518 Ligota, Poland but no later than 14 days from the day you withdrew from the contract.

We will refund the payments made by you, including the costs of delivering the item on the terms indicated in the terms and conditions, immediately, but no later than 14 days from the day we receive your declaration of withdrawal from the contract.

We may withhold the reimbursement of the payment received from you until we receive the item back or you provide proof of its return, whichever event occurs earlier.

** Please remember that the right to withdraw from a distance contract is not available to the consumer, among others, in relation to a contract:

• where the subject of the performance is a non-prefabricated item, manufactured according to the consumer's specifications or intended to satisfy their individualized needs,
• where the subject of the performance is an item liable to deteriorate or expire rapidly,
• where the subject of the performance is an item supplied in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery,
• where the subject of the performance are sound or visual recordings or computer software supplied in a sealed package, if the package was opened after delivery
• for the supply of digital content which is not supplied on a tangible medium, if the performance has begun with the consumer's express consent before the expiry of the withdrawal period and after being informed by the entrepreneur about the loss of the right of withdrawal.

Complaints

If the goods purchased from us turn out to be defective, you have the right to complain about them based on the warranty (rękojmia). The complaint should preferably be submitted to the email address: elty@elty.pl or by post to the address ul. Przedszkolna 24, 43-518 Ligota, Poland.

If you are not a consumer, we are liable to you only up to the amount of the order placed by you, within one year from the date of delivery of the goods. The following provisions apply to consumers.

In connection with a defect, you may demand:

• replacement of the item with one free from defects,
• removal of the defect,

or submit a declaration of:

• price reduction,
• withdrawal from the contract – in the case of a material defect.

We are liable to you for defects found within two years from the date of delivery of the item.

As a rule, you can report a complaint within one year of noticing the defect, but the time for submitting a complaint cannot end before the expiry of the seller's liability period.

Your complaint will be considered (responded to) within 14 days from the date we receive your complaint notification. **
